GENERAL TERMS OF USE

Revesto is a marketplace website owned and managed by Svimark S.r.l.

By using the services offered on Revesto, the customer fully accepts these General Terms of Use.

ELECTRONIC COMMUNICATIONS

Dear customer, when you use the services offered by Revesto or send us emails and other communications from your computer or mobile device, you are communicating with us electronically. In accordance with the obligations set out in the Consumer Code (Legislative Decree No. 206 of 2005) and, more generally, all applicable regulations, for the purposes of this contract, you agree that all contracts, notifications, disclosures, and other communications that we provide to you electronically meet the requirement of written form, where required by law.

COPYRIGHT AND DATABASE RIGHTS

All content made available through Revesto’s services or found on websites owned or managed by Revesto — including text, graphics, logos, icon buttons, images, audio files, digital downloads, data collections, and software — is the property of Revesto or its suppliers and is protected by national and international copyright and database laws.

It is not permitted to use data mining, robots, or similar data gathering or extraction tools to extract (once or repeatedly), or reuse, any substantial part of any of Revesto’s services without express written consent. It is also not permitted to create and/or publish a database that reproduces substantial parts (e.g., prices and product listings) of Revesto’s services without express written consent from Revesto.

TRADEMARKS

Graphics, logos, page headers, icon buttons, fonts, and service marks included or made available through any of the services provided by Revesto are trademarks or distinctive signs of Revesto. Revesto’s trademarks and distinctive signs may not be used in connection with products or services that are not Revesto’s, in a way that could create confusion among customers or in any manner that could denigrate or discredit Revesto.

All other trademarks not owned by Revesto that appear on any of Revesto’s services are the property of their respective owners, who may or may not be affiliated with, connected to, or sponsored by Revesto.


YOUR ACCOUNT

You may need a Revesto account to use some services and may be required to log into your account and have a valid payment method associated with it.


ACCOUNT CREATION PROCEDURE

To proceed with the creation of your Revesto account and ensure its security, you must provide your email address and choose a unique and personal username and password. Please note that temporary or fake email addresses are not allowed for the purpose of account registration.


CUSTOMER IDENTIFICATION DURING ACCOUNT CREATION

Dear customer, during the registration process and at any time, you may be asked to send a copy of an identity document or provide a phone contact, to verify your identity as a buyer and thus prevent potential online fraud. You are free to choose whether to comply with this request. However, Revesto’s decision to proceed with the registration—whether the document is sent or not—is discretionary and cannot be contested.

The submission of documentation will be handled in accordance with the privacy regulations under the GDPR (EU Regulation No. 2016/679).


USER OBLIGATIONS

Our aim is to provide services within a safe, reliable, and secure environment for the entire community of users who access and use the services offered on our website.

By accessing and using the website and services, the user agrees to:

  • Comply with these Terms and Conditions as well as all applicable laws;

  • Provide truthful, accurate, and up-to-date information about themselves, and promptly update their account in case of changes (e.g., change of residence and/or shipping address);

  • Keep their login credentials and password confidential, and promptly report any suspected misuse or unauthorized access;

  • Assume full responsibility for the use of data, photographs, or other content uploaded to the Site.

USER PROHIBITIONS

When creating an account and using the Revesto website or services, the user agrees not to:

  • Commit illegal, immoral, or harmful acts against public safety or acts that infringe upon the rights of others (such as the right to privacy, confidential information, or intellectual property);

  • Use external software tools (including, but not limited to, bots, scraping programs, crawlers, spiders) during account registration or while using the Site or Services (e.g., to promote items or add items to favorites), unless such use is expressly authorized or permitted by us;

  • Use external software tools aimed at disrupting the normal operation of the Site or Services, or at infecting or damaging other users’ devices;

  • Adapt, copy, modify, distribute, or commercialize any content on the Site without our prior written consent;

  • Perform data mining, screen scraping, crawling, disassembling, decompiling, or reverse engineering any part of the Site;

  • Post content that incites, promotes, or encourages terrorism, racism, historical revisionism, xenophobia, homophobia, sexism, hate speech, discrimination, human trafficking, organized crime, illegal organizations, self-harm, suicide, torture, animal cruelty, glorification of war crimes, sexual exploitation of minors and/or adults, cults, or other illegal content;

  • Repeatedly delete and repost the same item for sale or bulk upload items with the intent of destabilizing the Site;

  • Collect, hold, or disclose unlawfully obtained information about other users, their content, or activities on the Site, or any published information that could infringe third-party rights;

  • Promote other websites or commercial activities through advertisements on our Site.

These provisions aim to preserve the security and integrity of our Site and the Services offered, in accordance with current regulations and principles of good faith.

If there is an issue processing the charge on your selected payment method, we may charge any other valid payment method associated with your account.

If you use the services offered by Revesto, you are required to keep your account and password confidential and to monitor access to your computer and devices. You agree, to the extent permitted by applicable law, to be held responsible for all activities conducted with your account and password. You agree to take all necessary precautions to ensure that your password remains secure and confidential and to inform us immediately if you suspect that any third party has gained knowledge of your password, or if your password is or is likely to be used without authorization. You must ensure that the information you provide to us is correct and complete and promptly notify us of any changes. You may access your account information at any time in the “My Account” section of the site.

We reserve the right to deny access to the site and/or the services offered by Revesto, suspend or close an account, remove or modify site content at our discretion, including in the case of violations of applicable law, these General Terms of Use, or relevant guidelines or policies.

As part of our ongoing monitoring of accounts deemed fraudulent, Revesto also reserves the right to temporarily withhold payments resulting from transactions. If payment release is authorized or further information is required, Revesto will notify the seller by email.

If the seller’s account is deemed fraudulent by Revesto, we may delete the account and suspend any payments related to it. Conversely, if the account is not deemed fraudulent by the appropriate fraud prevention authorities and/or Revesto, a new payment order will be issued in favor of the seller.

The seller hereby expressly waives any claim for reimbursement, including interest or any other form of compensation, resulting from the temporary withholding of funds by Revesto in connection with the transaction.

If a user wishes to delete their account, they must send an email to support@revesto.it expressing their intention to delete the account, specifying the account to be deleted in the body of the email. The account will be deleted within 48 business hours from receipt of the email.

The Revesto Marketplace allows free access to the site, but operations can only be carried out after registration. Specifically, on Revesto, two types of users can be created, as described below:

  • User: a user who can purchase products listed for sale on the Revesto marketplace.

  • Artist: an individual who can sell a product or offer product customization services to Users.

Both accounts may be linked to the same email address. However, to purchase a product, the User account must be used, while to sell a product or a customization service, you must access the “Artist” interface, which is available only to those registered as Artists. Depending on the account used, the User or Artist is subject to the contractual terms provided for that specific account type.


INTELLECTUAL PROPERTY RIGHTS VIOLATIONS

Revesto operates transparently and is actively committed to respecting third-party intellectual property rights. Therefore, if you believe that your intellectual property rights have been used in a way that may constitute a violation, we invite you to contact us immediately at: support@revesto.it.


APPLICABLE LAW AND JURISDICTION

These General Terms of Use are governed by and must be interpreted in accordance with Italian law (with the exception of provisions on conflict of laws). The application of the United Nations Convention on Contracts for the International Sale of Goods is expressly excluded. If you are a consumer and have your habitual residence in the European Union, you may benefit from the additional protections provided by the mandatory rules of your country of residence. As a consumer, you may bring a dispute relating to these General Terms of Use before the courts of the EU Member State in which you reside or are domiciled.

CHANGES TO THE SERVICE OR TO THE TERMS

We reserve the right to modify the services offered by Revesto, the policies, these General Terms of Use, and the Terms of Service at any time in order to offer new products or services or to comply with legal and regulatory requirements. You will be subject to the policies and terms of the General Terms of Use in effect at the time you use the services offered by Revesto. Should any provision of these terms be deemed invalid, void, or for any reason unenforceable, such condition shall not affect the validity and enforceability of the remaining provisions.


WAIVER

If you breach these General Terms of Use and we do not take action, this does not constitute a waiver of our right to take action for the breach of obligations you have assumed.


MINORS

Products may not be sold to minors on Revesto. Products for children may be sold, but only to adults. If you are under the age of 18, you may use Revesto’s services only with the involvement of a parent or guardian.

GENERAL TERMS OF SALE

These General Terms of Sale govern the sale of products and, where applicable, services through the website when Revesto operates as a marketplace (“General Terms of Sale”).

We invite you to carefully read these General Terms of Sale before making any purchase or sale of a product or customization, as by making any purchase/sale, you fully accept these General Terms of Sale.

THE SALES CONTRACT

Revesto is a marketplace that connects sellers and buyers and offers complementary services to the sale process. For this reason, Revesto is not a party to the sales transaction, which involves only the seller and the buyer, and assumes no responsibility for the proper execution of the sales contract, the quality of the goods, or for any damage resulting from the said contract. In this respect, Revesto does not act as a reseller of the products and does not acquire ownership of the products at any time. Users act in all circumstances on their own behalf, never as agents or representatives of Revesto. Revesto is not a party to the sales contract concluded between the buyer and the seller and declines any liability arising from such contract and its consequences.

Any quality control activity possibly carried out by Revesto is solely intended to verify that the product sold by the seller matches the description provided in the product listing created by the seller. The fact that Revesto may organize or subcontract the delivery of products does not imply, in any way, that Revesto becomes a party to the contract entered into between seller and buyer.

The presentation of products and services on the site constitutes an invitation to make an offer by the sellers using the marketplace, which acts as a virtual showcase to offer their products or the customization of either the seller’s or the buyer’s items.

If you wish to purchase one or more products, you may select them one at a time and add them to your cart. Once you have selected all the items you intend to purchase, you can proceed to checkout and place your order. A summary page will appear showing the selected products, their price, and the delivery options (with related costs). You will be asked to select your preferred delivery, shipping, and payment method.

At the top of the same page, you will find the “Place Order” button, which you must click to send your order.

Your order will then be considered as your contractual purchase offer addressed to the sellers using the Revesto marketplace for the listed products, each considered individually. Upon receipt of your order, you will automatically receive a confirmation message summarizing the product you intend to purchase, the total cost, the selected shipping method, the chosen payment method, and your billing and shipping addresses, as well as any additional service fees. Afterwards, you will receive another email from the seller confirming the acceptance of your order. However, the order will remain pending until Revesto confirms the receipt of payment and the seller verifies the product’s availability in their warehouse.

As previously stated, the Order Receipt email does not constitute acceptance of your purchase offer. By sending the Order Receipt, we merely confirm that the seller/Artist has received your order and that it is undergoing verification of the data and availability of the products requested from the seller. The sales contract is concluded only when we send you a separate email confirming acceptance of your purchase offer (Order Confirmation), which will also include information regarding the product’s shipment.

Regarding the use of discount coupons reserved for affiliated users or promotional offers, any request for a discount using such a coupon will be verified for compliance with the coupon’s terms of issuance. As a result, Revesto will confirm the discount’s validity, after verification, and determine the final total price in the order acceptance email.

If there are discrepancies between the product purchased and the product delivered—if the customer believes they received a different item from the one purchased—the proof of purchase will be based on the invoice, the fiscal receipt, or the order confirmation email. In all cases, any claims will be directed to the seller, who alone can be held responsible and against whom any compensation actions may be taken. Revesto will do its best to assist the parties in resolving the dispute, but remains external to the relationship between seller and buyer.

By accepting these terms of sale, you agree to receive invoices in electronic format. These documents will be sent to the email address you provided, but only if explicitly requested by email or via the chat service.

All orders placed on the site must reflect normal consumer needs. This requirement applies both to the number of products purchased in a single order and to multiple orders relating to the same product, even when each order includes a quantity consistent with normal consumer use.

TYPES OF PURCHASE

As previously stated, Revesto is a marketplace that connects sellers and buyers and offers complementary services to the sales process.

While browsing Revesto, the User is put in contact with the Artist and may carry out the following actions:

  • Purchase a product from an Artist;

  • Purchase a product already customized by an Artist;

  • Purchase a customization service by the Artist for one of the User’s own products.

In the case of purchasing a customization service, the User must, through the dedicated chat connecting User and Artist, agree on the customization to be carried out, providing the Artist with all necessary information. Once the customization has been defined, the User must click on (send item) and download the shipping label, which must be attached to the shipping box. The User must then proceed with the shipping payment and hand over the parcel, with the attached label, to the courier.

Unless otherwise agreed in writing via chat, the Artist will have 30 days to complete the customization and send the finished product back to the User.

When purchasing a customization service, the User pays both the shipping label for sending the item and the return label at the time of purchase. However, the payment to the Artist is only released by the payment platform once the User has received the customized product and confirmed that it matches the agreed customization.

It remains understood that Revesto is not involved in any matters related to the sale or the customization service. The sale and/or customization involve only the seller and the buyer, and therefore Revesto assumes no responsibility for the correct execution of the sales or customization contract. In the event of a disagreement between the requested and the executed customization, Revesto will attempt to mediate a fair resolution. However, if the parties are unable to reach an amicable solution—even with Revesto’s assistance—Revesto cannot be held liable and may, at most, decide to exclude either the User, the Artist, or both from the marketplace.


REVESTO’S ROLE AND RESPONSIBILITIES

Users acknowledge and agree that, unless otherwise expressly stated regarding the products offered through the website, Revesto solely acts as an intermediary between users. Therefore, and except in special circumstances, Revesto does not act as a reseller of the products and does not acquire ownership rights to them at any time.

Each user acts solely in their own name and on their own behalf, never as an agent or representative of Revesto.

Therefore, Revesto is not a contractual party to the sales agreement concluded between the buyer and the seller, and it expressly disclaims any responsibility arising from that contract or its possible consequences.

Any quality checks carried out by Revesto will be strictly limited to verifying that the product conforms to the description published on the Site by the seller. Revesto will not verify whether the product or its description meets the buyer’s expectations. Consequently, Revesto does not guarantee the buyer’s satisfaction with the product, either in terms of appearance or functional or practical use.

The seller alone is fully responsible for handling any requests or complaints related to their advertised products, their descriptions, or user comments on the product’s page, as well as the shipping and delivery of the products (whether part of a sale or return). Any such claim must be addressed directly to the seller, who is solely responsible for managing the products in question.

CUSTOMER IDENTIFICATION IN THE ORDER ACCEPTANCE PROCESS

Dear customer, as previously stated, orders are considered as contractual purchase proposals addressed to the sellers using the Revesto marketplace.

Upon receipt of the order, you will automatically receive an acknowledgment message. However, the order will remain pending until Revesto confirms receipt of payment and the seller verifies the availability of the product in stock or accepts the customization service.

It may occur—based on alerts from Stripe, PayPal, a credit institution, or at the discretion of Revesto or the Artist—that you are asked to provide a copy of an identity document or a phone contact, to verify your identity as a buyer and thus prevent potential online fraud. You are free to accept or decline this request. However, Revesto’s decision to proceed with the sale, whether the document is submitted or not, is discretionary and cannot be contested.

The documentation will be handled in compliance with the privacy regulations set forth by the GDPR (EU Regulation No. 2016/679).

PRODUCTS

Products sold by sellers through Revesto’s website are new unless otherwise specified.

RIGHT OF WITHDRAWAL, EXCEPTIONS AND RETURN POLICY

Dear customer, except for the exceptions listed below, you have the right to withdraw from your order without providing any reason within 14 days from the day you received the ordered product (or the last product, lot, or item in the case of multiple deliveries). If a trusted person collects the item on your behalf, your withdrawal period begins from the day the product is delivered to the designated person, other than the courier. If the delivery is made to a locker, the 14-day period starts from when you are notified of the product’s arrival.

We must inform you that the right of withdrawal, pursuant to Articles 52 et seq. of Legislative Decree No. 206 of 2005, applies only to consumers (natural persons acting for purposes unrelated to any business, commercial, craft, or professional activity) and not to professionals, as defined in Article 3 of the same Decree. Therefore, if a product is purchased by a professional (a natural or legal person acting in the course of their business, commercial, craft, or professional activity, or an intermediary), the right of withdrawal does not apply, and the provisions of the Civil Code will apply. The status of “consumer” applies only to natural persons and is granted only if the contract is entered into for personal needs unrelated to professional or business activity.

To exercise your right of withdrawal, you must notify Revesto of your intention to withdraw from the contract using the following method:

  • By following the automated procedure, by clicking on “orders” in the “My Profile” section.

To validly exercise your right of withdrawal, the related notice must be sent before the 14-day period expires and the product must be returned to the seller.

For anything not expressly covered in these sales terms, please refer to Legislative Decree No. 206 of 2005.

OWNERSHIP AND RISK OF PRODUCTS

Ownership of the products shall remain with the seller until full payment of the order price has been received from the buyer, including all applicable costs and additional charges (such as taxes, potential authentication fees, shipping costs, customs duties, and any other applicable charges). The transfer of the risk of loss or damage to the products passes to the buyer upon receipt of the product by the buyer or by a third party designated by the buyer. As a result, the buyer shall bear the risks associated with any damage to the product occurring after delivery.

PRODUCTS NOT CONFORMING TO THE DESCRIPTION ON THE PRODUCT PAGE

Please note that Revesto’s involvement in handling requests or complaints regarding purchases from commercial sellers is solely intended to facilitate the process and, where possible, avoid legal proceedings. However, such involvement does not imply that Revesto is a party to the sales contract.

If the product is only partially consistent with the description provided on the relevant page, it is the buyer’s responsibility to notify the seller of any defects or discrepancies found. The buyer will have 48 hours to report any lack of conformity by clicking the “Everything is fine” button or by indicating a problem related to the sale or customization service. In the latter case, Revesto will receive the report through the App and will communicate via email with both the artist and the user in order to attempt an amicable resolution of the dispute. If a discrepancy is confirmed, the seller is obliged to refund the amounts paid by the buyer.

It is understood that Revesto is not involved in the relationship between buyer and seller, and therefore any dispute must be resolved exclusively between the artist and the user, releasing Revesto from any and all responsibility.

If the products do not match the description provided by the seller on the product page, or if they are found to be counterfeit or their sale is prohibited, Revesto will cancel the transaction and the seller will issue a refund to the buyer. Under no circumstances shall Revesto be held liable for failure to intervene and/or for being unaware of any counterfeit or non-compliant products.

In the event of cancellation of the transaction, the buyer will receive a refund, which will be credited to the original payment method used. In the case of partial cancellation, only the portion of the order that was canceled will be refunded, where applicable, as described above.

In any case, the commission owed by the artist to Revesto for the transaction will still be due and will be retained by Revesto. The artist may not request reimbursement of the commission from Revesto in the event of withdrawal, non-conformity, or for any other reason for cancellation of the order.

CONDITIONS FOR LISTING AND APPROVAL OF A PRODUCT FOR SALE

Any holder of a valid account on Revesto is entitled to advertise a product for sale on the marketplace, acting either as an artist or as a user.

Revesto reserves the right not to publish, or to cancel the publication of, a sales listing for the following reasons:

  • The product in question is prohibited under Revesto’s Terms of Use, as it is contrary to public morals or its sale is forbidden by legal, regulatory, or contractual provisions. This includes, among others, counterfeit goods or products sold in violation of selective or exclusive distribution networks;

  • There is an error in the product description provided on the listing page;

  • The seller’s account on Revesto is suspended or deleted for any reason;

  • The advertised product has already been sold.

EFFECTS OF EXERCISING THE RIGHT OF WITHDRAWAL

When exercising the right of withdrawal, you will be refunded all payments made for the product in question, including shipping costs corresponding to the most economical delivery method offered, within 14 days from the day we receive the notice of withdrawal. The refund will be issued using the same payment method used for the original order unless otherwise explicitly agreed upon in the form or email. In any case, you will not incur any charges as a result of this refund. We may withhold the refund until the seller has received the returned product or until proof of return has been provided, whichever occurs first.

Please note that you have 14 days from the date you declare your intention to withdraw to return the product. You will be responsible for the direct cost of returning the products. No additional costs will be charged for exercising your right of withdrawal; however, you may be held liable for any decrease in the value of the goods resulting from improper handling (i.e., use beyond what is necessary to determine the nature, characteristics, and functionality of the goods).

Please remember that Revesto is a marketplace that connects sellers and buyers and offers complementary services to sales. Therefore, Revesto is not a party to the sales agreement and has no responsibility regarding the proper execution of the sales contract or compliance with return policies, including the return of merchandise and the reimbursement of the purchase price.

DELAYS OR FAILURE TO RECEIVE THE PRODUCT

If the buyer does not receive the product within 30 days from the order date, they have the right to cancel the order, provided that the customization (if applicable) does not require more time to complete.

The seller must refund the buyer within 15 calendar days from the date the cancellation notice is received from the buyer.

If the buyer receives the product after the transaction has already been canceled, they must return it, and the seller will still be required to refund the product price, along with shipping costs (if the entire order is returned) and the costs related to returning the product, within 14 calendar days of receiving the returned product in its original and complete condition. The return process must comply with the terms stated in the previous section of this document.

In case of cancellation, the refund to the buyer will be made by crediting the amount to the credit card used for payment, or to the buyer’s PayPal or Stripe account, provided that Revesto does not consider the cancellation or refund request for non-delivery of the product to be fraudulent. In the case of partial cancellation, only the canceled portion of the order will be refunded under the terms described above.

EXCEPTIONS TO THE RIGHT OF WITHDRAWAL

The right of withdrawal does not apply in the following cases:

  • The supply of sealed goods which are not suitable for return due to health protection or hygiene reasons and which were unsealed after delivery, or in the case of products that, after delivery, are inseparably mixed with other items;

  • The supply of goods made to measure or clearly personalized;

  • The supply of goods from which the label has been removed;

  • The supply of goods that are liable to deteriorate or expire rapidly.

Revesto declines any responsibility in case of loss or damage to the products during transport. The seller may refuse the return of products that are damaged, incomplete, or altered, or may deduct from the refund an amount corresponding to the damages caused to the products, provided such damage occurred after their delivery to the buyer.

The buyer will also be held responsible for any reduction in the value of the products resulting from improper use or handling beyond what is necessary to determine their nature, characteristics, and functioning, as well as for any damage caused by willful misconduct, fault, negligence, or carelessness, whether their own or that of third parties. Similarly, the buyer will be held liable for any use of the products not in accordance with their intended purpose, for failure to comply with the instructions provided by the manufacturer or by Revesto, and for any modifications or repairs made without Revesto’s prior consent.

PRICES AND AVAILABILITY

All prices are inclusive of VAT as required by law.

Information about the availability of products sold on Revesto is provided on the website, including on each product’s presentation page. In addition to the information provided on that page or elsewhere on the site, we cannot offer more precise indications regarding product availability. Please note that estimated shipping and delivery times are purely indicative and cannot be fully relied upon. Once your order has been received, you will be notified via email if any of the products you ordered are unavailable.

Despite our best efforts, it is possible that a small number of products in our catalog may have an incorrect price listed. We will verify the pricing of products during the order verification and shipping process. If, due to a mistake or other issue, the price on the website is lower than the correct selling price of a product, we will contact you to confirm whether you still wish to purchase the product at the correct price. Otherwise, your order cannot be accepted. If the correct price of a product is lower than the one listed on the site, we will charge you only the lower amount and still send you the product.

CUSTOMS AND SALE OF PRODUCTS IMPORTED INTO THE EUROPEAN ECONOMIC AREA

If goods ordered from Revesto are to be delivered outside of Italy, they may be subject to import duties and taxes, which are levied once the package reaches the specified destination. Any additional customs clearance costs will be the responsibility of the Buyer. We have no control over these charges and cannot predict their amount. Customs policies vary widely from country to country, so we advise you to contact your local customs office for more information. Please also note that when you place orders on the site, you are considered the importer and are therefore required to comply with all laws and regulations of the country in which you receive the goods. Your privacy is important to us, and we understand that you care about how your order information is used and shared. Please be aware that cross-border deliveries are subject to inspection and opening by customs authorities.

Revesto reserves the right to require sellers based outside the European Economic Area or offering products located outside of this area to provide documentation proving they have obtained proper authorization from the intellectual or industrial property rights holder for the products in question.

If the seller fails to provide such documentation, Revesto reserves the right to cancel any transaction and suspend the seller’s account.

ADVERTISEMENT OF COUNTERFEIT OR PROHIBITED PRODUCTS

Revesto is committed to taking all possible measures to prevent the sale of counterfeit goods, protecting both consumers and intellectual property rights holders.

As part of our verification procedures, Revesto undertakes all reasonable efforts to prevent users from selling counterfeit or otherwise prohibited products. This includes, but is not limited to, products that violate applicable laws or regulations, infringe third-party rights, or are resold without proper authorization.

Sellers, by listing products on Revesto, agree and warrant that the products offered are not counterfeit and that their sale is not prohibited. However, if a buyer receives a counterfeit item or one whose sale is prohibited, despite the seller’s due diligence, the buyer may return the item and receive a refund of the purchase price.

If it is confirmed that a product is counterfeit or its sale is prohibited, it will be immediately removed from circulation, and the seller’s account may be suspended either temporarily or permanently.

Furthermore, if a counterfeit or prohibited product is offered for sale on our marketplace, the seller accepts the risk that the item may be seized by the competent authorities or the brand owner, who may take possession of or destroy the item. In such cases, the seller is responsible for recovering the product at their own expense and risk.

If a counterfeit or prohibited product is seized after the sale by the relevant authorities or the brand owner or rights holder, the transaction will be canceled. The seller will be required to refund the buyer for the amount received, and the buyer agrees to indemnify Revesto from any legal action.

If the product is not seized by the relevant authorities or the brand owner, the buyer must return the product to the seller.

If the seller wishes to recall their products for a specific reason, they must contact Revesto’s customer service. The seller will also be required to pay a fee determined on a case-by-case basis to cover the non-reimbursable administrative costs incurred by Revesto. Upon receipt of this payment, Revesto will return the product to the seller within 15 working days.

Please note that counterfeiting is subject to specific civil and criminal penalties, and Revesto, being uninvolved in the relationship between buyer and seller, accepts no liability for the sale of counterfeit products.

In case a buyer raises doubts about a product’s authenticity, Revesto reserves the right to request all necessary documentation from the seller to verify the product’s authenticity and to suspend the seller’s account until such documents are received. Revesto also reserves the right to contact the seller directly to verify the product’s authenticity.

APPLICABLE LAW AND JURISDICTION

These General Terms and Conditions of Sale are governed by and must be interpreted in accordance with Italian law, with the express exclusion of the United Nations Convention on Contracts for the International Sale of Goods. You and we both agree to submit to the jurisdiction of the Italian courts. As a consumer, you may bring a claim before the courts of Italy or the EU member state in which you are resident or domiciled in connection with these General Terms and Conditions of Sale. If you are a consumer and your habitual residence is within the European Union, you may benefit from the additional protections provided by the mandatory provisions of the law of your country of residence.

CHANGES TO THE GENERAL TERMS AND CONDITIONS OF SALE

We reserve the right to modify the site, policies, and these General Terms and Conditions of Sale at any time to offer new products or services, or to comply with legal or regulatory requirements. You will be subject to the policies and terms of the General Terms and Conditions of Sale in force at the time you order products from us, unless any changes to those policies or terms are required by applicable law or governmental authority (in which case they will apply to orders you have previously placed as well). If any provision of these conditions is deemed invalid, void, or for any reason unenforceable, such condition shall not affect the validity and enforceability of the remaining provisions.

WAIVER

If you breach these General Terms and Conditions of Sale and we take no action, we will still be entitled to use our rights and remedies in any other situation where you breach these conditions.

MINORS

Products on Revesto cannot be sold to minors. Products for children may be offered but can only be purchased by adults. If you are under 18, you may use Revesto’s online services only with the involvement of a parent or guardian.
